Terms of Service

1. Agreement

By creating a Duta account or using the Duta API, dashboard, or any related service (collectively, "the Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

These Terms incorporate our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Duta provides a transactional email API and platform that allows developers and businesses ("tenants") to send transactional emails to their own end users. Duta is not a marketing email platform. The Service is strictly limited to transactional use cases including, but not limited to: account verification, password resets, order confirmations, notifications, and system alerts.

3. Acceptable use

You may only use the Service to send email that:

  • Is transactional in nature (triggered by a specific user action or system event)
  • Is sent to recipients who have a direct relationship with your application or service
  • Complies with all applicable laws in the jurisdictions of both sender and recipient
  • Complies with the AWS Acceptable Use Policy

4. Prohibited uses

You must not use the Service to:

  • Send unsolicited bulk email, newsletters, or marketing campaigns
  • Send to purchased, rented, scraped, or third-party email lists
  • Send spam, phishing, or any content designed to deceive recipients
  • Distribute malware, viruses, or malicious code
  • Impersonate another person, company, or domain you do not own
  • Send email from domains you do not own or are not authorised to use
  • Circumvent or attempt to circumvent sending quotas, rate limits, or other platform controls
  • Resell or sublicense access to the Service without prior written consent from Duta
  • Violate any applicable law including anti-spam legislation (CAN-SPAM, GDPR, PDPA, and equivalents)

5. Tenant responsibilities

You are solely responsible for the emails you send through the Service, including their content, the validity of recipient addresses, and compliance with applicable laws. Specifically, you must:

  • Only send to recipients who have a legitimate expectation of receiving email from you
  • Honour all unsubscribe and opt-out requests promptly
  • Maintain low bounce and complaint rates in line with industry standards (bounce rate below 5%, complaint rate below 0.1%)
  • Not attempt to re-send to addresses that have hard-bounced
  • Ensure your sending domain's WHOIS information is accurate
  • Include accurate sender identification and a valid reply-to address in your emails

Duta's automated suppression pipeline will block sending to addresses that have bounced or complained. You must not attempt to remove or bypass these suppressions.

6. Domain verification

You must verify DKIM ownership of any domain you use as a sending domain before sending email. By verifying a domain, you confirm that you own or are authorised to send email on behalf of that domain. Duta enforces this at the API level — send requests from unverified domains are rejected.

7. Quotas and limits

Your account is subject to plan-based monthly email quotas, daily sending caps (on the Free plan), per-API-key rate limits, and domain limits. These are described on our Pricing page. Duta reserves the right to adjust limits to protect platform reliability and deliverability for all tenants.

8. Suspension and termination

Duta may immediately suspend or terminate your account, without prior notice, if we determine that:

  • You have violated these Terms or the AWS Acceptable Use Policy
  • Your sending activity is generating abnormal bounce or complaint rates
  • Your account is being used to send spam or harmful content
  • Continued access poses a risk to other tenants, recipients, or our email infrastructure

You may terminate your account at any time by contacting us at support@duta.indra.sh.

9. Billing

Paid plans are billed monthly in Malaysian Ringgit (MYR). Fees are non-refundable except where required by law. Duta reserves the right to change pricing with 30 days notice to active paying tenants.

10. Disclaimer and limitation of liability

The Service is provided "as is" without warranties of any kind. Duta does not guarantee email delivery, inbox placement, or uptime. To the maximum extent permitted by law, Duta's liability to you for any claim arising from use of the Service is limited to the fees you paid in the three months preceding the claim.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email to active tenants at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
