Terms of service

Duta is taking accounts now. These terms are published so they can be read before you sign up, and they take effect the day the service starts accepting customers.

These terms govern your use of Duta, a transactional email API operated from Malaysia. By creating an account you agree to them, together with the Acceptable use policy and the Privacy policy, which form part of this agreement. If you do not agree, do not use the service.

The service

Duta accepts an API request and delivers it through Amazon SES on your behalf. It is a transactional service: one-time passcodes, password resets, receipts and similar messages a recipient expects as a result of something they did. It is not for marketing or bulk campaigns, and the Acceptable use policy sets out what may not be sent.

Your account

You need an account to send. You are responsible for everything sent with your API keys, so keep them secret and revoke any you no longer use. You must be able to enter a binding contract and must give accurate account details.

The Free sandbox

A new account starts on the Free sandbox. It sends only from a sandbox address we assign, only to up to three addresses whose owners confirmed they want your test mail, and at most 10 emails a day, with a notice added to each message saying it came from a sandbox. It is for trying the API, not for sending to your users. We may change its limits or withdraw it.

Payment

Sending to your own users from your own domain needs a paid plan, billed in advance through our payment processor, Stripe, either monthly or yearly at the lower yearly price. On both, the plan includes an email allowance for each calendar month. Email past the allowance is charged per 1,000: on a monthly plan it is billed on your next invoice, and on a yearly plan it is invoiced once the month closes. A monthly overage cap, RM100 unless you change it, stops sending past the allowance once that month's overage reaches it; you can raise it, lower it or remove it in Settings. If a renewal cannot be collected after the payment processor's retries, the plan ends and the account moves to the Free sandbox, and any overage already used is still owed. Cancelling stops the next renewal and the plan runs to the end of the period already paid for. A yearly plan is not refunded for the unused part of the year except where Malaysian law requires it.

Prices are shown in Ringgit and may change. We will tell account holders before a price change takes effect. Credit already purchased is not refunded except where Malaysian law requires it.

What we owe you

We aim to deliver promptly, but the service is provided as is, without a guaranteed uptime or delivery rate. Email passes through third parties, including Amazon SES, and we cannot promise that a message will reach an inbox.

We may suspend sending on an account to protect the platform or other customers, for example when a reputation threshold is crossed or an abuse report is upheld.

Your data

We handle personal data as described in the Privacy policy. You are responsible for having a lawful basis to email the recipients you send to, and for honouring their requests to stop.

Suspension and termination

Confirmed abuse results in immediate suspension, as set out in the Acceptable use policy, and credit consumed before that suspension is not refunded. You may close your account at any time. We may close an account that breaches this agreement, with notice where the breach is not serious.

Liability

To the extent the law allows, our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect or consequential loss, including lost profit or lost data.

Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over any dispute.

Changes

If these terms change in a way that affects you, account holders are emailed before the change takes effect.
